Description The Affirmative Litigation, Innovation and Enforcement Division includes three affirmative litigation units: (1) the Neighborhood Law Corps (“NLC”), (2) the Community Lawyering & Civil Rights Unit (“CLCR”); and (3) the Housing Justice Initiative (“HJI”). The NLC is a longstanding community-facing unit that focuses on core life, health, and safety issues such as tenant protection, substandard housing, and public nuisance. There are five budgeted NLC attorneys; and they typically are relatively new to the practice of law. The NLC was established in 2002. The Community Lawyering and Civil Rights Unit is dedicated to advancing systemic rights and opportunities for historically and presently marginalized communities in Oakland by enforcing, strengthening, and creating laws responsive to those communities’ needs, in furtherance of racial, economic, and environmental justice. CLCR was founded in 2016 and is typically staffed by at least two mid-level attorneys. The HJI is dedicated to protecting marginalized Oakland tenants and preserving affordable housing in Oakland by enforcing tenants’ legal rights. HJI was founded in 2020 and typically is staffed by two mid-level attorneys. CLCR was founded in 2016 and is typically staffed by at least two mid-level attorneys. PUBLIC GUARDIAN The Office of the Public Guardian (PG) acts as a court appointed fiduciary to individuals who are unable to provide for their own self-care or resist fraud or undue influence when there are no viable alternatives to public conservatorship. The Superior Court determines whether a conservatorship should be established, involving a court process that includes petitioning the court and notifying the proposed conservatee and his or her family of the proceedings. A conservatorship is only established as a last resort through a formal hearing. The Court can appoint the Public Guardian as a conservator of the person only, estate only (for probate), or both the person and estate. THE OPPORTUNITY: The current vacancy is within Health Care Agency's Public Guardian Lanterman-Petris-Short (LPS) Unit. The LPS unit responds to referrals from designated acute psychiatric hospitals, local jails, and the Superior Court to investigate persons who may be deemed Gravely Disabled due to a Mental Health Disorder and cannot provide for their own food, clothing, and shelter. The Supervising Deputy Public Guardian is responsible for reviewing and assigning LPS referrals, court order to show cause (O.S.C), administrations, terminations, decedent case administrations, and trust administrations, as well as general supervision of the LPS unit staff. The candidate must also seek and maintain educational credits and professional certification as required by California State Association of Public Administrators, Public Guardians, and Public Conservators. Job Description and Duties California state agencies manage our air, water, wildlife, forests and other natural resources, and when those agencies need advice or are in court, they turn to the Natural Resources Law Section for legal representation. We are looking for a bright, energetic attorney to join our section to help further our client agencies’ missions of protecting and fairly managing our state’s natural resources. You will be asked to advise and represent state agencies including the Air Resources Board, the State Water Resources Control Board and the nine regional water quality control boards, the Department of Water Resources, the Department of Fish and Wildlife and the Fish and Game Commission, CAL FIRE and the Board of Forestry, and the Department of Food & Agriculture, among others. Attorneys in the section will typically handle cases involving air pollution, water rights and water supply, water quality, CEQA, endangered species, wildfire cost recovery, and timber harvest plans, as well as business and corporate issues. The position’s duties include representing state agencies in litigation matters from soup to nuts: from providing pre-litigation advice, to every aspect of pre-trial and trial litigation, to appeals all the way to the US Supreme Court. You will serve as plaintiff’s counsel prosecuting civil environmental enforcement cases, and as defense counsel defending state agency actions. We advise some boards and commissions on compliance with open meeting laws and on other issues when asked. Most of your work will be in state and federal courts in California, but some could be in courts in other states as well.
