{"id":2077,"date":"2014-01-20T11:58:06","date_gmt":"2014-01-20T19:58:06","guid":{"rendered":"http:\/\/careersingovernment.com\/tools\/?p=2077"},"modified":"2014-01-20T12:59:02","modified_gmt":"2014-01-20T20:59:02","slug":"strategy-costing-core-public-sector-labor-negotiations","status":"publish","type":"post","link":"https:\/\/www.careersingovernment.com\/tools\/gov-talk\/about-gov\/public-sector-trends\/strategy-costing-core-public-sector-labor-negotiations\/","title":{"rendered":"Strategy and Costing:  The Core of  Public Sector Labor Negotiations"},"content":{"rendered":"<p><a href=\"https:\/\/www.careersingovernment.com\/tools\/gov-talk\/about-gov\/public-sector-trends\/strategy-costing-core-public-sector-labor-negotiations\/attachment\/runder-tisch-detail\/\" rel=\"attachment wp-att-2078\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft  wp-image-2078\" alt=\"Runder Tisch Detail\" src=\"https:\/\/www.careersingovernment.com\/tools\/wp-content\/uploads\/2014\/01\/negotiations.falkow.jpg\" width=\"302\" height=\"227\" srcset=\"https:\/\/www.careersingovernment.com\/tools\/wp-content\/uploads\/2014\/01\/negotiations.falkow.jpg 800w, https:\/\/www.careersingovernment.com\/tools\/wp-content\/uploads\/2014\/01\/negotiations.falkow-300x225.jpg 300w, https:\/\/www.careersingovernment.com\/tools\/wp-content\/uploads\/2014\/01\/negotiations.falkow-480x360.jpg 480w\" sizes=\"(max-width: 302px) 100vw, 302px\" \/><\/a>Among the many facets of public administration one can be immersed into, perhaps the most interesting (and at times nerve-racking) is that of public sector labor negotiations.<\/p>\n<p><span style=\"line-height: 1.5em;\">There are many great books, essays, and papers that discuss the broad field of negotiations and labor relations, and some even specialize in the public sector.\u00a0 While most cover topics such as bargaining styles, avoiding various pitfalls, dealing with and using power, and understanding the political landscape, in the post-economic downturn where pensions and retiree health benefits are handily outpacing sluggishly increasing revenues, it really boils down to two (2) things:\u00a0 strategy and costing.\u00a0<\/span><\/p>\n<p><span style=\"line-height: 1.5em;\">The first component, which is quite broad in scope, is that of strategy.\u00a0 Much akin to a chess game where moves and countermoves often dominate the playing field, it\u2019s important for a public administrator tasked with leading labor negotiations to set aside the proverbial \u201cus versus them\u201d mentality, step back, and develop a thorough strategy built upon an overall \u201cbig picture\u201d approach.\u00a0<\/span><\/p>\n<p><span style=\"line-height: 1.5em;\">Even an experienced negotiator versed in all the rules, regulations, and methodologies must still understand the organization\u2019s primary objective\u2014staying afloat.\u00a0 Typically, reducing costs and increasing productivity are the immediate driving forces, but the long-term viability of the organization cannot be forgotten.\u00a0 This can be counterintuitive because a long-term focus often contradicts what most elected officials that comprise an agency\u2019s legislative body are constantly looking for\u2014a short-term fix.\u00a0 They simply want to get through their next election cycle, and in order to accomplish this, their respective loyalty to one or more collective bargaining groups in exchange for financial or election-time support often takes precedence.\u00a0 Therefore, it is essential for the negotiator to thoroughly understand the needs of the legislative body he or she represents in order to factor that into the overall strategic plan.\u00a0 It\u2019s a multivariable equation of sorts made ever more complex by the changing dynamics of election seasons.<\/span><\/p>\n<p><span style=\"line-height: 1.5em;\">The second component is that of costing.\u00a0 Those who think that finance and budget are the only places where revenue projections, expense calculations, cost breakdowns, and benefit-based expenditure analyses reside clearly haven\u2019t spent a great deal of time at the bargaining table.\u00a0 Pension costs and retiree medical benefit costs continue a meteoric rise, and when these are coupled with increasing longevity of the average retiree, the end-game is not pretty.\u00a0 Having an in-depth actuarial analysis of the true cost of an agency\u2019s post-employment benefits is only part of that multivariable equation. The experienced negotiator cannot simply say, \u201chere are the numbers the Finance department has come up with, so accept the agency\u2019s proposal to reduce expenditures.\u201d\u00a0<\/span><\/p>\n<p><span style=\"line-height: 1.5em;\">Most collective bargaining groups let alone the employees they represent don\u2019t understand the numbers and worse, many distrust the agency\u2019s negotiation team.\u00a0 As such, it is essential for the experienced negotiator to not only understand how the numbers were derived, but also provide the calculations to the collective bargaining groups\u2019 leadership and negotiating teams so they too can try to understand them.\u00a0 Many won\u2019t try, but those that do, will be much easier to work.\u00a0<\/span><\/p>\n<p>In addition, the experienced negotiator must understand what led up to the implementation of the respective benefits in prior contracts and the potential legal basis for standing by their potential replacement or elimination.\u00a0 These knowledge points are essential before the experienced negotiator gets too far into negotiations, and should the negotiations ultimately end up proceeding to impasse, mediation, fact finding, etc., having done all this groundwork ahead of time will make this process much smoother.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Among the many facets of public administration one can be immersed into, perhaps the most interesting (and at times nerve-racking) is that of public sector labor negotiations. Dr. Falkow spent the first half of his career in the private sector as a computer scientist and senior project manager implementing medium-to-large scale solutions across a variety of industries, including banking and mortgage lending, insurance and finance, healthcare, the legal field, and local government. He spent the second half of his career at the City of Inglewood, California, serving first in the information technology and communications department as director and then serving as assistant city manager for 12 years until he retired at the end of 2018. Since 2014, Dr. Falkow has been teaching part-time for the College of Engineering and Computer Science and the College of Humanities and Social Science at California State University, Fullerton. Dr. Falkow earned his Bachelor of Science and Master of Science in Computer Science from California State University, Fullerton in 1990 and 1994, respectively. In 2013, Dr. Falkow earned his Master of Arts in Security Studies, Homeland Defense and Security from the United States Naval Postgraduate School in Monterey where he received the Outstanding Thesis Award for his thesis entitled, Does Homeland Security Constitute an Emerging Academic Discipline? Since 2014, Dr. Falkow has been teaching part-time for the College of Engineering and Computer Science and the College of Humanities and Social Science at California State University, Fullerton. Dr. Falkow earned his Bachelor of Science and Master of Science in Computer Science from California State University, Fullerton in 1990 and 1994, respectively. In 2013, Dr. Falkow earned his Master of Arts in Security Studies, Homeland Defense and Security from the United States Naval Postgraduate School in Monterey where he received the Outstanding Thesis Award for his thesis entitled, Does Homeland Security Constitute an Emerging Academic Discipline?
