Job Description

Minimum Qualifications

This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS).*
To be considered for appointment through NY HELPS, or 55b/c, candidates must meet the open-competitive minimum qualifications for this position.
The qualifications are:
Either A. a bachelor's degree* AND three years of experience performing inspections and/or appraisals of environmental or recreational lands to include writing detailed original appraisal reports or appraisal reviews, leasing, financing of real property with banks, lending institutions, mortgage organizations, or other financial organizations, OR writing detailed original appraisal reports or appraisal reviews in connection land acquisition for a Public land acquisition agencies, utility companies, or Not for Profit conservation organizations;
Or B. a New York State Land Surveyor's license with current registration AND two years of experience performing inspections and/or appraisals of environmental or recreational lands to include writing detailed original appraisal reports or appraisal reviews, leasing, financing of real property with banks, lending institutions, mortgage organizations, or other financial organizations, OR writing detailed original appraisal reports or appraisal reviews in connection land acquisition for a Public land acquisition agencies, utility companies, or Not for Profit conservation organizations.
Substitution: a Juris Doctor, master's or higher degree in a related field can substitute for one year of specialized experience.

If verifiable, we will accept and prorate part-time and volunteer experience.

Duties Description

The Real Estate Specialist 2 (Conservation) (RESC2) manages all aspects of land acquisition projects including engaging with and paying appraisers; reviewing appraisals of real estate and real property interests; performing ownership and real estate title research; reviewing easements, permits, leases, site visits, and surveys; working with land conservation groups; managing records; reviewing and rating projects; negotiating with private owners concerning the State’s acquisition of real estate and real property interests; interacting with executive staff and more. In addition, the RESC2 oversees and administers the Real Property Unit budget including funding from State and Federal sources that support the Land Acquisition Program.

RESC 2 duties include the responsibilities of the Real Estate Specialist 1 (RES1) and the additional duties outlined below:
• Supervises professional and clerical staff including assignment of work, coordination of workflow throughout the Real Property Unit, reviewing time off requests, and performing evaluations.
• Performs the more complicated transactions that cannot be delegated to RES1s or other subordinate staff.
• Communication & Records Maintenance:
o Manage budgetary, agency, and executive staff reporting
o Supervise recording and maintenance of existing real estate records, such as conveyance of interest, easements, and title searches.
• Budget:
o Manage the Real Property Section budget and reporting thereof.
o Manage funding from State and Federal sources that support the Land Acquisition Program.
o Oversee the HCA Federal Grant program, the Environmental Protection Fund’s Open Space Funding, the Utility Easement program, and the Conservation Easement program.
• Coordination & Negotiation:
o Work with Environmental Analysts, surveyors, Office of the Attorney General, Office of the Comptroller and NYS Historic Preservation Officer to obtain a NYS Environmental Quality Review; to interpret tax maps, survey maps and deed descriptions; to satisfy title concerns and other requirements.
o Interact with property owners and third-party groups or their legal representatives in the acquisition of State-owned land.
o Coordinate property acquisition in a geographic area including the preparation of cost estimates and Real Property contracts for signatures.
o Direct negotiations with property owners and landlords regarding services for lease terms and conditions, and conditions for sale.
o Carry out politically sensitive negotiations.
• Meet with the Department of Law concerning Court of Claims cases.

Additional Comments

*For the duration of the NY HELPS Program, this title maybe filled via a non- competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply. At this time, agencies may recruit and hire employees by making temporary appointments. In May 2024, if a temporary NY HELPS employee is satisfactorily performing in the position, the appointment status will be changed from temporary pending Civil Service Commission Action to permanent non-competitive and the official probationary period will begin. At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS, it is anticipated that HELPS employees will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified.
